Terms of Service

FlipYo is a peer-to-peer (P2P) platform only. FlipYo does not lend, borrow, own, inspect, or take possession of any item at any point. Every rental is a private transaction between a Lender and a Renter — responsibility for the item, its condition, and its use rests entirely with them, not with FlipYo.

Welcome to FlipYo, a peer-to-peer ("P2P") sharing platform that allows individuals to lend and rent items directly with one another. By using FlipYo, you agree to the following Terms of Service.

1. Role of FlipYo

FlipYo is a technology platform that facilitates connections between item owners ("Lenders") and users who wish to borrow items ("Renters"). FlipYo does not own, manufacture, inspect, or provide any of the items listed. We act solely as an intermediary connecting two independent parties.

  • Lenders are solely responsible for the condition, safety, legality, and suitability of the items they list.
  • Renters are solely responsible for their use of the items.
  • FlipYo does not guarantee or warrant the quality, safety, or fitness of any item.
  • All agreements regarding the item, its condition, its use, and its return are made directly between the Lender and the Renter. FlipYo is not a party to that agreement.

2. User Responsibilities

  • Lenders must ensure items are safe, functional, and comply with applicable laws and safety standards.
  • Renters agree to use items responsibly, follow all manufacturer guidelines, and accept items "as-is."
  • Both parties agree to provide truthful information, respect agreed return times, and resolve disputes in good faith, directly between themselves.

3. Insurance and Risk Allocation

  • FlipYo includes basic liability protection on every rental as standard, funded through FlipYo's service fee — there is no separate insurance charge at checkout. Optional full coverage add-ons may be offered for an additional fee for higher-value items. Any claim is handled directly by the insurance provider, not by FlipYo.
  • Unless explicitly covered by insurance, Lenders bear responsibility for defects in their items, and Renters bear responsibility for their use and care of items.
  • Renters acknowledge that they use items at their own risk.

4. Limitation of Liability

To the maximum extent permitted by Danish law:

  • FlipYo is not liable for any injury, damage, loss, or claim arising out of or in connection with the use, condition, or exchange of any item, except in cases of death, personal injury, fraud, or gross negligence, where liability cannot be excluded by law.
  • FlipYo is not liable for disputes between Lenders and Renters — any such dispute is a matter between the parties involved.
  • FlipYo's total liability under these Terms shall not exceed the greater of: (a) €50; or (b) the total platform fee paid to FlipYo in the three (3) months prior to the event giving rise to the claim.
  • Any liability arising from a personal data breach is governed separately under applicable data protection law and is not subject to the limitation above.
This clause now includes carve-outs for death, personal injury, fraud, gross negligence, and data protection liability. Pending final confirmation from legal counsel before publishing.

5. Payments and Fees

  • Lenders receive 80% of the agreed rental price as cash, subject to taxes and any agreed deductions.
  • FlipYo retains 18% of the rental price as a service fee, covering payment processing, MitID verification, insurance, and general operating costs.
  • 2% of the rental price is contributed to FlipYo's tree-planting partner, Klimaskovfonden, as part of the TreeCoins programme.
  • Payment processing is handled by third-party providers (e.g. Stripe). FlipYo is not responsible for errors, chargebacks, or delays caused by such providers.

6. Prohibited Items

Users may not list or rent:

  • Items prohibited by law.
  • Items unsafe for their intended use, or requiring professional certification to operate.
  • Cars, motorbikes, boats, horse boxes, and any other motor vehicle or watercraft.
  • Car trailers and boat trailers exceeding the weight limit towable under a standard category B licence, or requiring a higher towing licence category (BE/C1E).
  • Real estate, homes, or property rentals.
  • Weapons, ammunition, hazardous materials, or other illegal items.
  • Medical devices and equipment (e.g. mobility aids, oxygen equipment, prescription-related items).
  • Items with direct bodily or hygiene contact (e.g. underwear, swimwear unless new and sealed, breast pumps, baby bottles and pacifiers).
  • Food, beverages, cosmetics, and other perishable or single-use consumables.
  • Live animals and pets.
  • Cash, gift cards, cryptocurrency wallets, identity documents, and official seals or stamps.
  • Sexual wellness products and adult-only content.
  • Fine art, jewellery, and other high-value or collector's items, unless approved under a separate high-value listing process.
This list defines the categories excluded from FlipYo's insurance coverage. Confirm the final wording and any value thresholds with the insurance provider before publishing.

7. Disclaimers

FlipYo provides the platform "as-is" and "as-available," without warranties of any kind, and is not responsible for the actions, omissions, or conduct of any Lender or Renter, on or off the platform.

8. Governing Law & Disputes

These Terms are governed by Danish law. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark. Disputes between a Lender and a Renter regarding an individual transaction are the responsibility of those two parties to resolve.

9. Amendments

FlipYo may modify these Terms at any time. Users will be notified of material changes, and continued use of the platform constitutes acceptance.
